Subject: 9815/Non-conforming uses, outdoor storage, setbacks from alleys Date: Tue, 24 Apr 1990 11:55:00 -0500 ORDINANCE NO. 9815 AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO AMEND CERTAIN SECTIONS RELATIVE TO NON-CONFORMING USES, OUTDOOR STORAGE, AND SETBACKS FROM ALLEYS. __________________________ WHEREAS, The Chief Building Official for the City of Chattanooga has requested that certain changes be made to the Chattanooga Zoning Ordinance relative to non-conforming uses, outdoor storage, and setbacks from alleys; and WHEREAS, the Chattanooga-Hamilton County Regional Planning commission has reviewed and recommends a proposed amendment to the Chattanooga City Council; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, the Zoning Ordinance, be and the same is hereby amended as follows: SECTION 1. That Article VII, Section 103, is hereby amended by deleting in its entirety and inserting in lieu thereof the following language: 103. Nothing in this Ordinance shall be taken to prevent the restoration within one (1) year of a building destroyed to any extent by fire, explosion or other casualty, nor the continued occupancy of such building. In addition, a lot that had a single use consisting of a legal non-conforming manufactured home in a residential zone, that was destroyed by any of the above may, prior to the expiration of 100 consecutive days, have another manufactured home placed on the lot, provided that a new building permit shall be issued for this manufactured home, specifying that the manufactured home meets all the current regulations concerning building, plumbing, electrical and other codes applicable to the said unit. SECTION 2. That Article V, Section 507 and 607, be amended by deleting that section dealing with the presence of outdoor storage and substituting thereof the following language: ...shall be limited to 20% of the lot square footage, excluding the area where buildings are located, such... SECTION 3. That Article IV, be amended by adding Section 110 as follows: Setbacks from alleys, for buildings, or structures, shall be the same as the zone side and rear yard requirements. SECTION 4.
